လိပ္ကြ်န္းလူသတ္မႈႏွင့္ ပတ္သက္ၿပီး ဆႏၵျပ ျမန္မာမ်ား၏ ေနာက္ကြယ္မွ ေသြးထုိးလႈံေဆာ္ ႀကိဳးကုိင္ေနသည့္ အုပ္စုကုိ ရွာေဖြဖုိ႔ ထုိင္းရဲတပ္ဖြဲ႕က ျပဳလုပ္ေနတယ္လုိ႔ ရဲတပ္ဖြဲ႕ အႀကီးအကဲ Chakthip Chaijinda က ေျပာ လုိက္ပါတယ္။ ျမန္မာလူငယ္ ၂ဦး ေသဒဏ္ခ်မႈမွာ ဆႏၵျပပြဲေတြျဖစ္လာေစဖုိ႔ အုပ္စုတစုက ႏုိင္ငံေရးရည္ရြယ္ ခ်က္နဲ႔ မီးထုိးေပးေနတယ္လုိ႔လည္း စြပ္စြဲလုိက္ပါတယ္။ဆႏၵျပသူူေတြဟာ ၾကာသပေတးေန႔ကတည္းက ရန္ကုန္က ထုိင္းသံရုံး၊ တာခ်ီလိတ္၊ ဘုရားသုံးဆူ စတဲ့ ေနရာ ေတြမွာ ဆႏၵျပဖုိ႔ ေနရာယူထားတာျဖစ္ၿပီး၊ ဂ်ပန္က ထုိင္းသံရုံးေရွ႕မွာ ဆႏၵျပသလုိ သီရိလကၤာက ဘုန္းႀကီးေတြ နဲ႔ ခ်ိတ္ၿပီး ထုိင္းသံရုံးေရွမွာ ဆႏၵျပခဲ့တာျဖစ္တယ္လုိ႔ ဆုိပါတယ္။မန္မာႏုိင္္ငံျခားေရး၀န္ႀကီးဌာနကေတာ့ ဆႏၵျပပြဲမ်ား ေနာက္ကြယ္တြင္ မည္သည့္ အုပ္စုကမွရွိမေနဘူးလုိ႔ ဆုိလုိက္ပါတယ္။အရင္ကလည္း ျမန္မာ ၁၂၆ဦးကုိ လူသတ္မႈနဲ႔ အေရးယူခဲ့ေပမယ့္ အခုလုိ ဆႏၵျပတာေတြမျဖစ္ခဲ့ဘူး၊ ဒီအမႈမွာေတာ့ တခ်ဳိ႕အုပ္စုေတြဟာ တရားရုံးဆုံးျဖတ္ခ်က္ကုိ အတုိက္အခံလုပ္ဖုိ႔ ျပဳလုပ္ေနတဲ့အတြက္ ထုိင္းရဲတပ္ဖြဲအေနနဲ႔ ဒါေတြကုိ တားဆီးသြားမယ္လုိ႔ ဆုိပါတယ္။အထူးသျဖင့္ ရဲအထူးစံုစမ္းေရး အဖြဲ႔ေတြအေနဲ႔ ျမန္မာလူထုကုိ ေသြးထုိးလႈံေဆာ္သူကုိ ရွာေဖြေနဖို႔ အမိန္႔ေပး ထားတယ္လုိ႔ ရဲတပ္ဖြဲ႕ အႀကီးChakthip Chaijinda ကေျပာလုိက္ပါတယ္။

ၿဗိတိန္နိုင္ငံသား ၂ ဦးကို သတ္မွုနဲ႔ ျမန္မာနိုင္ငံသား ဝင္းေဇာ္ထြန္းနဲ႔ ေဇာ္လင္းတို႔ ကို ေအာက္ေၿခ တရား႐ုံးက ေသဒဏ္ အျပစ္ေပး ခဲ့တာနဲ႔ ပတ္သက္ၿပီး ထိုင္း ဥပေဒအတိုင္း ပဲ လုပ္သြားရမွာျဖစ္တယ္လို႔ ထိုင္းဝန္ႀကီးခ်ဳပ္ ပရာ့ယြတ္ က်န္းအိုးခ်ား က ေျပာၾကားခဲ့ပါတယ္။
ၿမန္မာ ေရႊ႕ေျပာင္း အလုပ္သမား ႏွစ္ဦးကို ေသဒဏ္ အမိန္႔ခ် ထားတဲ့ အေပၚ ထိုင္းအစိုးရက ျပန္လည္ သုံးသပ္ ေပးဖို႔ ျမန္မာ အစိုးရ ဘက္က တာဝန္ရွိသူ ေတြနဲ႔ အမ်ား ျပည္သူက ေတာင္းဆို ေနၾက ပါတယ္။
ဒီအေၾကာင္း ထိုင္းဝန္ႀကီးခ်ဳပ္ကို သတင္းေထာက္ေတြကေမးျမန္းေတာ့ သူက
"တရား႐ုံးက ဆုံးျဖတ္ၿပီးရင္ အယူခံ႐ုံးနဲ႔ တရား႐ုံးခ်ဳပ္ တို႔ကို ဆက္ၿပီး တင္နိုင္တယ္ မဟုတ္လား။ ျမန္မာ ဘက္ကိုလည္း ရွင္းၿပ လို႔ ရပါတယ္။ ျမန္မာ ဘက္က ေတာင္းဆို တာက တရား ဥပေဒ အတိုင္း မၽွမၽွတတေဆာင္ရြက္ ေပးဖို႔ ျဖစ္တယ္။ အမွုကို လုံးဝ ႐ုပ္သိမ္း လိုက္လို႔ ရမလား။ မရဘူး ဆိုရင္ မရတဲ့ အေၾကာင္း ရွင္းၿပ လိုက္ေပါ့။ အယူခံ ဝင္ခြင့္ ေပးထား တယ္ မဟုတ္လား။ ကမၻာ့ ဥပေဒ ေတြလည္း ဒီလိုပဲ ရွိတယ္ မဟုတ္လား။ ထိုင္းမွာ အယူခံ စရာ မလိုဘူးလား၊ ဖိအားေပး တာနဲ႔ အမွုကို ႐ုတ္သိမ္းလိုက္ တာမ်ိဳး လုပ္လို႔ ရပါမလား" လို႔ေျပာခဲ့ ပါတယ္။
ဒီအမွုကို တရားမၽွမၽွ တတ ေဆာင္ရြက္ ေပးဖို႔ ဗိုလ္ခ်ဳပ္မွူးႀကီး မင္းေအာင္လွိုင္က ထိုင္း ဒုတိယဝန္ႀကီးခ်ဳပ္ လည္းျဖစ္ ကာကြယ္ေရး ဝန္ႀကီးလည္း ျဖစ္တဲ့ ပရာ့ဝစ္ ဝုံးစူဝမ္း နဲ႔ ကာကြယ္ေရး ဦးစီးခ်ဳပ္ ဗိုလ္ခ်ဳပ္ႀကီး စုမ္မိုင္ ေကာင္းထီရာ့ ကို သဝဏ္လႊာ ေပးပို႔ ခဲ့ပါတယ္။
ဒါကို ျပန္လည္ ရွင္းျပဖို႔ ဗိုလ္ခ်ဳပ္ႀကီး စုမ္မိုင္ ေကာင္းထီရာ့ကို ဒုဝန္ႀကီးခ်ဳပ္ ပရာ့ဝစ္ ဝုံးစူဝမ္းက တာဝန္ေပး လိုက္ပါတယ္။
ဝင္းေဇာ္ထြန္းနဲ႔ ေဇာ္လင္းတို႔ ရဲ့အမွုကို အခမဲ့ အက်ိဳးေဆာင္ ေပးေနတဲ့ ထိုင္းေရွ႕ေနမ်ား ေကာင္စီက အယူခံဝင္မယ့္အေၾကာင္း သူတို႔ရဲ့ မိခင္ေတြကို ဒီဇင္ဘာ ၃၀ ရက္ေန႔မွာ ရွင္းျပၿပီး သတင္းစာ ရွင္းလင္းပြဲ ျပဳမယ္လို႔ ေၾကညာခ်က္ ထုတ္ျပန္ ထားပါတယ္။
ထိုင္းတရား႐ုံး ရဲ့ဆုံးျဖတ္ခ်က္ကို ရက္ေပါင္း ၃၀ အတြင္း အယူခံ ဝင္ရမွာ ျဖစ္ပါတယ္။
အယူခံ တရား႐ုံးမွာ ေအာက္ေၿခ တရား႐ုံးနဲ႔ ကြဲလြဲၿပီး အနိုင္ေပးတဲ့ အမွုေတြ အမ်ားအျပား ရွိခဲ့ဘူးတယ္လို႔ ျမန္မာ ႏွစ္ဦး ရဲ့ ေရွ႕ေန အဖြဲ႕ အႀကံေပး စူရာ့ဖုန္း ေကာင္းက်န္းထြတ္ခ္ က ရွင္းျပပါတယ္။

လိပ္ကၽြန္းအမႈေၾကာင့္ ေသဒဏ္က်ခံျမန္မာ ၂ ဦးအမႈမွန္ေပၚေပါက္ေစရန္အေရးကို စံုစမ္းေဖာ္ထုတ္ရန္၊        ရရွိတဲ့ အခ်က္အလက္ေတြနဲ႔ သက္ေသအေထာက္အထားေတြကို ေရးသား ထုတ္ေဖာ္ဖို႔ စီစဥ္ထားေၾကာင္း ထိုင္းသတင္းစာဆရာမ်ားအသင္းက ျမန္မာသတင္းစာဆရာမ်ား အသင္းကို ဒီဇင္ဘာ ၂၇ ရက္ ေန႔က     အေၾကာင္းျပန္ၾကားတယ္သိရတယ္။
ၿပီးခဲ့တဲ့ ဒီဇင္ဘာ ၂၅ ရက္က ျမန္မာသတင္းစာဆရာမ်ားအသင္းက လိပ္ကြၽန္းလူသတ္မႈမွာ ျမန္မာႏိုင္ငံသားႏွစ္ဦးကို ေသဒဏ္ခ်မွတ္လိုက္တာေၾကာင့္ ဒီအမႈရဲ႕ ေနာက္ကြယ္က အမွန္ တရားကို ေဖာ္ထုတ္ေရး ပူးေပါင္းေဆာင္ရြက္ေပးဖို႔ ထိုင္းသတင္း စာဆရာမ်ားအသင္းကို တိုက္တြန္းတဲ့စာပို႔ၿပီး ၂ ရက္အၾကာမွာ ျပန္လည္အေၾကာင္းျပန္လိုက္တာျဖစ္ပါတယ္။

‘‘အရွင္ဘုရားတို႔ လုပ္ႏိုင္တဲ့ အတိုင္းအတာထဲမွာရွိတယ္ဆို ရင္ ပိုေကာင္းတဲ့ ေျဖရွင္းနည္းေတြ ရွာေဖြဖို႔အတြက္ တရား႐ံုးနဲ႔ သက္ ဆိုင္သူေတြကို အယူခံ၀င္ေပးၾက ပါလို႔ ကြၽႏ္ုပ္ေတာင္းဆိုပါရေစ။ ၿငိမ္းခ်မ္းေရး၊ ေကာင္းမြန္တဲ့ဆက္ ဆံေရးနဲ႔ ဖြံ႕ၿဖိဳးတိုးတက္မႈ ရွိေစ ခ်င္တာက ကြၽႏု္ပ္ရဲ႕နက္႐ႈိင္းလွတဲ့ ဆႏၵပဲျဖစ္ပါတယ္’’ဟု ျမန္မာႏိုင္ငံ ၏ ပထမဆံုးကာဒီနယ္အျဖစ္ ယ ခုႏွစ္ဆန္းပိုင္းက ပုပ္ရဟန္းမင္း ႀကီးကိုယ္တိုင္ တာ၀န္ေပးအပ္ခဲ့ ေသာ ခ်ားလ္စ္ဘိုက ေတာင္းဆို ထားသည္။

၂၀၁၄ စက္တင္ဘာက ထိုင္းႏိုင္ငံေတာင္ပိုင္း လိပ္ကြၽန္း ကမ္းေျခတြင္ ၿဗိတိန္ႏိုင္ငံသားစံု တြဲ ဟန္နာ၀စ္သာရစ္ခ်္ႏွင့္ေဒးဗစ္ မီလာတို႔၏ အေလာင္းမ်ားကို ေတြ႕ရွိၿပီးေနာက္ ယင္းကြၽန္းရွိ စားေသာက္ဆိုင္၌ အလုပ္လုပ္ ကိုင္ေနၾကေသာ ေဇာ္လင္းႏွင့္၀င္း ေဇာ္ထြန္းတို႔ကိုအျပစ္ရွိေၾကာင္း စြပ္စြဲခ်က္ျဖင့္ ဖမ္းဆီးခဲ့ၾကသည္။
ထိုင္းရဲတပ္ဖြဲ႕အေနျဖင့္ ၎ တို႔ႏွစ္ဦးကိုစံုစမ္းစစ္ေဆးရာတြင္ ႏွိပ္စက္ညႇဥ္းပန္းမႈမ်ားရွိေၾကာင္း၊ သက္ေသခံကို လြဲမွားစြာ ကိုင္ တြယ္ေၾကာင္း အပါအ၀င္ စြပ္စြဲ မႈအမ်ားအျပားရွိေနခဲ့သည္။ သို႔ ေသာ္ ထိုသို႔ႏွိပ္စက္ခဲ့ေၾကာင္း သက္ေသမရွိဟုဆိုကာ ႏွိပ္စက္ ညႇဥ္းပန္းေၾကာင္း စြပ္စြဲခ်က္မ်ား ကို တရား႐ံုးက ပလပ္ခဲ့သည္။
၁၄ လၾကာၿပီးေနာက္၂၀၁၅ ဒီဇင္ဘာ ၂၄ ရက္တြင္ ၎တို႔ႏွစ္ ဦးကို ေကာ့စမြီတရား႐ံုးက ေသ ဒဏ္ခ်မွတ္ခဲ့သည္။ ၎တို႔ႏွစ္ဦး ကို တစ္ႏွစ္ေက်ာ္တိုင္ ေကာ့စမြီ အက်ဥ္းေထာင္၌ ထိန္းသိမ္းထားခဲ့ရာမွ ၂၀၁၅ ဒီဇင္ဘာ ၂၆ ရက္တြင္ ေတာင္ပိုင္းျပည္နယ္နက္ခြန္ဆီသမ္မရတ္ရွိ လံုၿခံဳေရး အဆင့္ျမင့္အက်ဥ္းေထာင္သို႔ေျပာင္းေရႊ႕ခဲ့သည္။ ေသဒဏ္ခ်မွတ္ ခံထားရေသာ ျမန္မာႏွစ္ဦးအေနျဖင့္ တစ္လအတြင္း အယူခံၾကမည္ျဖစ္ေၾကာင္း သိရသည္။

"သု႔အေနနဲ႔ လိပ္ကြၽန္းလူသတ္မူကို စိတ္ဝင္စားတယ္ေပါ့။ေနာက္ၿပီး ရေနာင္းလူသတ္မူက စြပ္စြဲခံထားရတဲ့ ျမန္မာလုပ္သားေတြအေၾကာင္းလည္း စိတ္ဝင္းစားတယ္ေျပာပါတယ္။သူက ထိုင္းႏိုင္ငံမွာ႐ွိတဲ့ ေရြ႔ေျပာင္းလုပ္သားေတြအေရးကို အကုန္စိတ္ဝင္စားတယ္ေပါ့။ေနာက္ၿပီးလိုအပ္တဲ့အကူညီေတြေပးမယ္လို႔ ေျပာပါတယ္"ဟု ဦးထူးခ်စ္က ေျပာသည္။

Myanmar's army chief has called on Thai officials to review the conviction of two of its nationals for the murder of two UK backpackers in Thailand in 2014.
It follows protests in Myanmar (also known as Burma) against the death sentences for Zaw Lin and Wai Phyo.
They were found guilty on Thursday of killing UK nationals Hannah Witheridge, 23, and David Miller, 24.
Thai police have defended their investigation, denying allegations that the two men were forced to confess.
The military chief in neighbouring Myanmar, General Min Aung Hlaing urged a "review of the evidence" against the two men, the state-run Global New Light of Myanmar reported on Sunday.
He said he wanted to "avoid a situation in which the innocent...were wrongly punished", in a new year message to the senior Thai junta leaders.
Migrants workers Zaw Lin and Wai Phyo both deny killing David Miller, and the rape and murder of Hannah Witheridge. They said they were forced by Thai police into confessing under duress, which they later retracted.
Hundreds took part in protests which erupted outside the Thai embassy in Yangon, as well as in some towns across Thailand, after Thursday's court ruling, calling for the men's release.

Defence lawyers have accused Thai police of bungling the investigation and using the men as scapegoats, and are planning to appeal against the sentences.
But Thai police spokesperson Gen Dejnarong Suthichanbancha told reporters on Sunday that the investigation "was done transparently and was in compliance with international standards".
During the trial, prosecutors said DNA evidence collected from cigarette butts, a condom and the bodies of the victims linked Lin and Phyo to the deaths.
The BBC's Jonathan Head, who followed the case closely, has described the police investigation as a muddled affair with hazy, contradictory and sparse information. 
Rights groups, including Amnesty International, have also condemned the police for failing to investigate allegations the accused were tortured into confessing.
The backpackers' bodies were found on a Koh Tao island beach, Thailand, in September 2014. They were both bludgeoned to death, and a post-mortem examination showed Miss Witheridge had been raped.
The killings have dented Thailand's reputation as a tourist hotspot and raised questions over its justice system and police competency.
Thailand, which has more than 450 prisoners on death row, has not executed anyone since 2009.

YANGON - Myanmar's army chief has called on Thailand to review the sentencing of his two countrymen to death for murdering a pair of British backpackers after a controversial trial that sparked protests.
General Min Aung Hlaing, head of the country's influential military, has asked Thailand for a "review of the evidence" against the two men, the state-run Global New Light of Myanmar reported on Sunday.
Zaw Lin and Win Zaw Tun were found guilty on Thursday of killing David Miller, 24, and the rape and murder of Hannah Witheridge, 23, whose battered bodies were found on a beach in the southern Thai diving resort of Koh Tao in September last year.
The grim killings have sullied Thailand's reputation as a tourist haven and raised questions over its justice system after the defence accused the police of bungling their investigation and using the men as scapegoats -- a charge authorities deny.
The verdicts have sparked anger in Myanmar with daily protests held outside the Thai embassy in Rangoon and at border crossings with the country's eastern neighbour.
The Global New Light of Myanmar said General Hlaing expressed his concerns about the verdict in a New Year message to senior Thai junta leaders, including Deputy Prime Minister General Prawit Wongsuwan.
"The commander-in-chief expressed his respect for Thailand's judicial process while stressing the need to avoid a situation in which the innocent... were wrongly punished," the newspaper reported.
The statement is the strongest suggestion yet that senior Myanmar leaders are unhappy with the Thai court's decision amid a surge of sympathy for the two accused in their homeland.
Protesters in Myanmar were planning a fresh series of rallies outside Rangoon's famed Shwe Dagon pagoda on Sunday afternoon.
Thai prosecutors and police insist their evidence against the men -- both migrant workers -- was rock solid, including DNA found on Witheridge's body.
But the defence, which has vowed to appeal the verdict, disputed the forensic evidence, saying it was improperly collected and processed.
They also accused the police of torturing their clients into signing confessions, which they later retracted.
Amnesty International has accused Thai authorities of failing to independently investigate those allegations.
Activists say the case reflects a wider trend of low-paid migrant workers from neighbouring countries being blamed for crimes in Thailand where the justice system is easily bent by wealth and power.
However the Thai authorities have received an endorsement from Miller's family who backed investigators after the verdict was announced, saying they believed the evidence against the two accused was "overwhelming".
The court in Koh Samui also dismissed the defence's torture allegations.
On Saturday Zaw Lin and Win Zaw Tun were moved to a high security prison in Nakhon Si Thammarat on the southern Thai mainland where many death row inmates are held.
Although Thailand retains capital punishment, executions are rare.

Lawyers council asks Myanmar people to be calm

The Lawyers Council of Thailand has urged Myanmar people protesting over the death sentence handed to two migrant workers over the Koh Tao murders to stay calm as the judicial process was not finished.
Zaw Lin and Win Zaw Tun, were found guilty on Thursday by the Koh Samui Provincial Court of killing David Miller, 24, and raping and murdering Hannah Witheridge, 23, on a beach on Koh Tao island of Surat Thani province in September last year.
Dissatisfied by the court's ruling, Myanmar people in Thailand as well as in Yangon and in major border towns along the border with Thailand have staged protests, demanding a review of the case.
The Lawyers Council of Thailand, which fought the case on behalf of the two workers at the request of the Myanmar embassy, issued a statement on Sunday, distributed by its president Det-udom Krairiksh. It called for the people of Myanmar people to have confidence in the Thai justice system.  
The statement said its legal assistance committee believes that when the case reaches the Appeals Court, or even the Supreme Court, all factual evidence in defence of the two defendants which had been presented to the court of first instance would eventually be found solid and substantial.
The council said it would like to assure the Myanmar ambassador, relatives of the defendants and the Myanmar people that its lawyers would perform their duty to the best of their ability and forward the case to the Appeals Court in time as required by law, said the statement.
It said the Myanmar ambassador and the parents of the two defendants would meet with a council legal team on Dec 30 at 1.30pm. The council's lawyers would explain to them in detail about steps to be taken and legal points to be raised to further fight the case in the higher courts.
At this stage, the two defendants are still regarded as innocent. There are still two more courts to ensure justice, it said.
"Please have confidence in the Thai justice process and the work of the council's senior lawyers," the statement said.
Mr Det-udom said copies of the statement have been handed to the Myanmar embassy as well as to the Foreign Affairs Ministry so that it can be translated into Burmese for the Myanmar people to better understand the Thai justice process.

Celebrity forensic scientist Dr. Pornthip Rojanasunand provided this assessment in testimony today in the high-profile ongoing Koh Tao murder trial currently taking place on the island of Koh Samui.

DNA SAMPLES


A key part of the prosecution's case is a match between DNA samples found on the victim's body and the bodies of the two defendants.

Defence lawyers asked for the police to hand over the DNA samples that the police used to make this match, for independent verification, but were told by police that there was nothing left of the evidence for re-testing.

Almost a year after the murders, police did agree to hand over the garden hoe murder weapon, as well as a shoe and a plastic bag for independent examination and verification.
 
Police have testified in trial already that they did fail to take DNA samples from the garden hoe used in the murder, choosing to take fingerprints instead.

Unlike the police, Dr. Pornthip's team did take DNA samples from the garden hoe.

They found that there was DNA of two males on the bloody garden hoe found near the victim but that this DNA did not match that of the accused.

Dr Pornthip was also critical of police handling of the crime scene and improperly collecting evidence at the crime scene.

Dr. Pornthip cited police failure to analyse the blood that was found at the crime scene.

Dr. Pornthip also cited the moving of one victim's body from the place where she was killed, an action that could potentially destroy evidence.

Police have previously been accused of intimidation and abuse of witnesses also.

Dr. Pornthip is the head of the Central Institute of Forensic Science under the Ministry of Justice that is independent of the police, a post she is due to retire from next month upon her 60th birthday.

Dr. Pornthip rose to celebrity status through a rivalry with the police in which she was highly critical of sub-standard police forensic work.
